1. Organizer of the competition & scope of application

These terms and conditions apply to the prize draw during the period from February 14, 2024 (4:00 PM) to February 15, 2024 (5:00 PM) which is organized by Melissa Beyer, Rotterdamer Platz, 55120 Mainz (hereinafter referred to as the Organizer). By participating, each participant accepts these terms and conditions. This giveaway is in no way affiliated with, sponsored by, endorsed by, or administered by Instagram, and does not create any legal claims against Instagram. All information relating to this giveaway is provided exclusively by the Organizer.

2. Terms and Conditions of Participation

Participation is open to any natural person acting in their own name and aged 18 or over. Persons under 18 and those legally incapacitated are excluded from participation. The organizer reserves the right to amend and modify these terms and conditions at any time. Changes will be announced on the organizer's social media platforms. Participation is only possible within the period specified in the competition description. Each participant may only enter the same competition once. Participating companies are excluded from participation. The organizer reserves the right to exclude participants from the competition who violate these terms and conditions, manipulate the competition, or act fraudulently. In such cases, the organizer may also exclude participants from the competition, revoke prizes, and reclaim them.

3. Implementation of the prize draw

To participate, you must follow the organizer's Instagram channel @melissabeyer.de. Any further requirements for participation will be stated directly in the giveaway details. All participants who meet the conditions outlined in points 2 and 3 will be considered. Immediately after the closing date, the winner will be drawn at random from among the participants. The prize cannot be exchanged for cash or otherwise redeemed.

4. Prize Settlement & Notification

The winner will be notified via Instagram story and private message, and possibly via a post on the social media platform Instagram. If the winner does not respond within 14 days, the prize will be forfeited or a new winner will be drawn. If the participant's provided contact information is incorrect (e.g., wrong email address), the organizer is not obligated to verify the correct information. Any resulting disadvantages are the responsibility of the participant.

5. Public announcement of the winner

The winner will be announced via social media platforms and agrees that their name, Instagram profile or place of residence (e.g. city) may also be made public.

6. Transfer of rights to contributions

All participants agree that their submitted contributions (e.g. comments, photos) may be used by the organizer for advertising and marketing purposes.

7. Prize and validity of the concert tickets

The winner receives 2x concert tickets for the concert series “Melissa Beyer” at Café Auszeit in Melsungen, each worth €10 (dates of your choice: 06.07.2024, 07.09.2024 or 23.11.2024).

8. Restrictions on concert tickets

The two concert tickets to be won can only be redeemed for one of the dates in Melissa Beyer's concert series: July 6, 2024, September 7, 2024, or November 23, 2024, at Café Auszeit, Kasseler Straße 53, 34212 Melsungen. No other claims can be made. The tickets cover only admission to the concert; food and drinks are not included. The tickets can only be used for the specified dates. Melissa Beyer reserves the right to exclude certain dates from the voucher's redemption. The voucher cannot be used for services outside of Melissa Beyer's aforementioned concert series.

9. Transferability of the profit

The prize is only transferable to third parties with the prior written consent of Melissa Beyer.

10. Can the prize be combined with other discount promotions?

The prize cannot be combined with other discounts or offers from Melissa Beyer.

11. Liability for Defects/Disclaimer

Melissa Beyer is not liable for any damages arising in connection with participation in the competition or the use of the prize, unless such damages are due to intent or gross negligence on the part of Melissa Beyer. Furthermore, liability for material defects and/or defects of title is excluded.

12. Premature termination, modification or cancellation of the competition

Melissa Beyer reserves the right to change, suspend or prematurely terminate the competition at any time without prior notice if this is necessary for legal reasons or other important reasons exist.

13. Data Protection

The data collected as part of the competition may be used for the execution of the competition and for advertising purposes, but will not be passed on to third parties. 14. Other

Legal recourse is excluded. Should individual provisions of these terms and conditions of participation be or become invalid, the validity of the remaining provisions shall remain unaffected.

15. Warranty Disclaimer

The organizer assumes no liability for the accuracy and completeness of the information provided in connection with the competition. By participating in the competition, the participant agrees to these terms and conditions.
